Aktuelle Entscheidung vom Bundesverfasssungesgericht.
Die Beschlüsse des Landgerichts Wuppertal vom 3. Dezember 2013 - 26 Qs 151/13 - und des Amtsgerichts Wuppertal vom 1. Juli 2013 - 8 Gs 710-713/13 - verletzen die Beschwerdeführer zu 1. bis 3. in ihrem Grundrecht aus Artikel 13 Absatz 1 Grundgesetz, soweit darin die Durchsuchung der Geschäftsräume der D. GmbH angeordnet wurde.
Der Beschluss des Landgerichts Wuppertal vom 3. Dezember 2013 - 26 Qs 151/13 - wird insoweit aufgehoben und die Sache zur erneuten Entscheidung an das Landgericht Wuppertal zurückverwiesen.
Im Übrigen wird die Verfassungsbeschwerde nicht zur Entscheidung angenommen.
Das Land Nordrhein-Westfalen hat den Beschwerdeführern zu 1. bis 3. ihre notwendigen Auslagen zu erstatten.
Der Wert des Gegenstands der anwaltlichen Tätigkeit wird auf 10.000 € (in Worten: zehntausend Euro) festgesetzt.
G r ü n d e :

1. Gegen einen der Geschäftsführer der Beschwerdeführerinnen zu 1. und 2. wurde wegen des Verdachts der Beteiligung an einer Steuerhinterziehung in besonders schwerem Fall ermittelt. Die Beschwerdeführerin zu 3. und der Beschwerdeführer zu 4. verfügten über Büroräume unter derselben Adresse wie die Beschwerdeführerinnen zu 1. und 2. Die elektronischen Daten der Beschwerdeführer zu 1. bis 4. befinden sich auf einem gemeinsamen Server.

2. Mit angegriffenem Beschluss ordnete das Amtsgericht unter anderem die Durchsuchung sämtlicher Geschäftsräume der „D. GmbH, A.-str., M.“ an. Eine ausdrückliche Eingrenzung auf einen oder mehrere der Beschwerdeführerinnen zu 1. bis 3. erfolgte nicht. Nach Schilderung des Tatverdachts führte das Amtsgericht aus, die Durchsuchung diene dem Auffinden sämtlicher Unterlagen in schriftlicher oder digitaler Form, die Auskunft geben könnten, welche Überlegungen und Erwägungen unter anderem von den Beschuldigten zur Verlegung und Begründung verschiedener Geschäftssitze angestellt worden seien, wie die Beschuldigten ihr Vorgehen selbst eingeschätzt, insbesondere ob sie es selbst als noch steuerehrlich angesehen hätten und welche betrieblichen Tätigkeiten welcher der Gesellschaften von welchen Personen wo tatsächlich ausgeführt worden seien.

3. In Durchführung des Durchsuchungsbeschlusses spiegelte die Staatsanwaltschaft den gesamten Datenbestand der Beschwerdeführer zu 1. bis 4. und stellte diesen sowie weitere auf einem in einem Büroraum aufgefundenen Firmenlaptop gespeicherte Daten vorläufig sicher.
